PHILLIPS, Chief Judge.

Glenn Acord was injured by a mail pouch thrown by a mail clerk, who was an employee of the United States, from a moving train owned and operated by *711the Chicago, Rock Island & Pacific Railroad Company.1

Acord brought an action against the Railroad Company in the Western District of Oklahoma to recover the damages resulting from such injuries. The Railroad Company filed a third-party complaint against the United States, seeking indemnity for all sums that might be adjudged against it in favor of Acord.
