Clark delivered the opinion of the Court.
The hill in this case was filed for the purpose of having an alleged contract, with reference to the sale of real estate, declared forfeited and to recover a judgment for money paid by complainant to defendants on said contract.
It is charged in the hill that the defendants, T. H. Harrison and Joe M. Black, were-partners under the name and style of Harrison & Black, and that they were engaged in the sale of real estate; that they were the owners of a valuable tract of land near the city of Murfreesboro, Tenn., which tract of land they *159…
