This action arises out of a collision between the automobiles driven by Loman C. Adams, plaintiff and respondent, and Henry E. Warren, defendant and appellant, on Telegraph Road near the city of Los Angeles, in the nighttime on August 18, 1933. The case was tried before a jury, and a verdict for the sum of $30,000 was returned in respondent’s favor. The evidence shows that respondent was operating his automobile in a westerly direction on Telegraph Road approaching the east end of Rio Hondo River bridge at a speed of approximately 40 miles per hour.
