MEMORANDUM OPINION AND ORDER

This Adversary Proceeding was commenced by the plaintiff Community National Bank (“CNB”) by Complaint filed on June 12,1998, seeking to have a debt of the defendant Daniel L. Slominski (“Slominski”) in excess of $160,000.00 declared nondischargeable pursuant to 11 U.S.C. § 523(a)(2)(A). Slominski’s debt to CNB arises from a default judgment which CNB obtained against him in the District Court for the County of Grand Forks, State of North Dakota, Civil Case No. 97-C-960.
