Plaintiffs brought this action seeking a declaratory-judgment as to their rights, status, and legal relations with the defendant with regard to a contract entered into by defendant with John and Dorothy Mach. Trial was had resulting in a decree that the contract involved was not a covenant running with the land and was not binding on the plaintiffs or any grantees of plaintiffs; that the contract being in restraint of trade was void as against public policy and for the purpbse of suppressing competition in a lawful business; that the contract was void for want of and failure of consideration;…
