ORDER DENYING DEFENDANT’S MOTION TO DISMISS PLAINTIFFS’ COMPLAINT AND GRANTING PLAINTIFFS’ MOTION TO PRODUCE

Plaintiffs applied to defendant for a certificate authorizing plaintiffs to commence the banking business under 12 U. S.C. § 27. The defendant, refused to approve the application. Plaintiffs brought this action alleging that the decision of the defendant was “unreasonable, arbitrary and capricious, an abuse of discretion, and contrary to the provisions of 12 U.S.C. § 27.” Defendant moved to dismiss.
