OPINION AND ORDER

REYNOLDS, Chief Judge.

This is a civil rights action for financial and equitable relief wherein it is claimed that policemen struck and arrested plaintiff James Wood without cause while the police were attempting to control a gathering in one of the parks of the City of Milwaukee. The defendants Breier, Mentkowski, Marshal, Block, and Miller, Jr., pursuant to Rule 12(b) of the Federal Rules of Civil Procedure, have moved to dismiss this action for failure to state a claim and for lack of jurisdiction necessary to grant relief.
