Appeal from the County Court, Placer County. The defendant was sentenced to the State Prison for the term of fifteen years, and appealed from an order denying a new trial. The other facts are stated in the opinion of the Court.

The defendant was convicted of the crime of robbery, committed by taking four ounces of gold dust from the person of a Chinaman named Ah Po. There was no evidence tending in the slightest degree to support the charge except extrajudicial statements by the defendant and a co-defendant of a somewhat loose character, made to one party, who was also arrested for the offense, and to another who was a feigned accomplice in another subsequent transaction, that they had taken eleven ounces of gold dust from some five to seven Chinamen working on a certain ravine, one of whom…
