The defendant was tried and found guilty of murder in the first degree. The death penalty was imposed. He appeals from the judgment and from the order denying his motion for a new trial.
The victim of defendant was a married woman, who had been intrusted by her husband with money arising from the sale of their business in an eastern state. She came to California with defendant and they lived together as husband and wife. They purchased a place in Elmhurst in Alameda County, where they resided.
