Richard Stringfellow was indicted in the circuit court of Issa-quena county for the murder of Decatur Whitley, and at the November term, 1852, of said court, the accused was found guilty of murder, and sentenced to be hung. The plaintiff in error was indicted and tried in the circuit court of Issaquena, and convicted of the murder of Decatur Whitley. The bill of exceptions filed to the decision of the court overruling the motion for a new trial, embodies the whole of the evidence submitted to the jury. Several exceptions were taken to the ruling of the court in reference to the admission of evidence on the trial.
