MEMORANDUM OPINION
MacGUIGAN, Judge:
In August of 1979 Appellees negotiated a first real estate mortgage for the construction of certain improvements on real property owned by them in Owasso, Oklahoma. Appellees entered into a contract for the construction of an office building. During the construction of the improvements on Appellees’ property, the Appellant purchased the lot adjoining Appellees’ lot.
