MEMORANDUM OF OPINION
I. INTRODUCTION
MANOS, District Judge.
On April 19, 1991, Linda P. Ditto, plaintiff, filed Case No. 5:91CV0722 in federal court on behalf of her deceased husband, Robert V. Ditto (“Ditto”), against Monsanto Company, SunOhio n/k/a ENSR (“ENSR”), Ohio Transformer Corporation, and Controlled Power Corporation, defendants. On the same day she filed identical claims against these defendants in the Court of Common Pleas for Stark County.
