FINDINGS OF FACT AND CONCLUSIONS OF LAW
HUGH GIBSON, District Judge.
Plaintiff, William T. Brown, seeks damages and injunctive relief against the defendant Magness Company, Inc., for its failure to renew a lease agreement covering an Exxon service station operated by the plaintiff.
On July 17, 1985, the Court heard plaintiff’s motion for a preliminary injunction which, by the parties’ agreement, was extended to cover all declaratory and permanent injunctive relief.
