This appeal, No. 8995, is one of two appeals from an order of the Public Utilities Commission of the District of Columbia. The facts are to be found in the opinion in the companion case No. 8967, Potomac Electric Power Company v. Public Utilities Commission of the District of Columbia, - U.S.App.D.C.-, 158 F.2d 521. In its appeal the United States through two agencies suing in their capacity as consumers contends that the Commission’s order permits some $29,000,000 of surplus to remain as an element in the rate base.
