This is an action under §§ 43-704 to 43-710 of the District of Columbia Code challenging an order of the Public Service Commission of the District of Columbia (hereafter “Commission”) granting the Potomac Electric Power Company (hereafter “Pepeo”) an increase in rates. The matter first came before the District Court in October, 1970, and was dismissed on procedural grounds without prejudice.
