MEMORANDUM OPINION AND ORDER
HADEN, Chief Judge.
Pending for some time in this action have been the motions for summary judgment of the Defendants, Owens-Illinois, Inc. (“the Company”), American Flint Glass Workers Union, AFL-CIO and Local Union 565 (collectively referred to hereinafter as “the Union”). The Plaintiffs difficulty with continuity of counsel delayed ruling on the motions. Having obtained new counsel, she has now responded to the dispositive motions. 1
