I. INTRODUCTION

Harvey Shade alleges that he was injured when a manlift that he was operating during his employment with ARCO Alaska unexpectedly shifted into high speed. Shade and his wife Anna sued Grove Manufacturing Company d/b/a Grove Manlift (Grove), the manufacturer of the manlift, and Peak Oilfield Services and Peak Alaska Ventures, Inc. d/b/a Peak Maintenance and Equipment Company (Peak), an independent contractor hired to maintain ARCO’s manlifts, for negligent repair, breach of implied warranty of repair, products liability, and loss of consortium.
