Appeal from a judgment of the superior court for What-com county, Kellogg, J., entered December 2, 1912, dismissing an action to enjoin an assessment, upon sustaining a demurrer to the complaint.

This action was brought for the purpose of enjoining the collection of certain reassessments for local improvements.
On May 25, 1908, the city council of Bellingham passed a resolution declaring its intention to construct a trunk sewer outlet on “C” street, between Holly and Laurel streets, and do such other work as might be necessary in connection therewith. This resolution reads as follows:
