DECISION and ORDER
TELESCA, District Judge.
This is a civil, in rem, forfeiture proceeding filed by the United States of America against the defendant premises and real property (“Portland Avenue”). Plaintiff filed a verified complaint for forfeiture pursuant to 18 U.S.C. § 1955(d). That section provides that “any property, including money, used in violation of the provisions of this section may be seized and forfeited to the United States.” The complaint alleges that the defendant premises was used in violation of § 1955 in that five (5) or more persons conducted a gambling business having…
