The plaintiff in error herein will be referred to as the defendant, and the defendant in error as plaintiff, as the parties stood in the trial court.
This controversy arises out of a partnership venture. On the 25th day of May, 1920, the plaintiff, defendant, and Neely Orme entered into a partnership for the purpose of buying and selling cotton in the vicinity of Hugo, Okla. The said partnership continued for a period of 15 days, and the only business transacted by said partnership consisted of a purchase and sale of 107 bales of cotton.
