MEMORANDUM OPINION

KESSLER, District Judge.

This matter comes before the Court upon Defendant’s Motion for Summary Judgment [# 35], Plaintiffs Motion for Partial Summary Judgment [# 46], and Defendant’s Motion to Dismiss Second Amended Complaint, or, in the Aternative, for Summary Judgment [# 78]. Plaintiff, John E. Lutes, brings this action alleging discrimination on the basis of race and sex in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq., and on the basis of age in violation of the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621 et seq.…
