Appellant John T. McFarland was passed over for a promotion and eventually terminated by his former employer, The George Washington University (“GW”). He later alleged that GW had engaged in race discrimination, gender discrimination, and retaliation in violation of the District of Columbia Human Rights Act (“DCHRA”), D.C.Code §§ 2-1401.01 et seq. (2001).
