The plaintiff in erre r, S. S. Scott, as plaintiff, instituted this action in the county court of Garvin county on the 11th day of March, 1922, to recover $572.89 as a balance alleged to be due on a promissory note executed by the defendant, F. P. Standridge. It appears that the note had been given as part of the purchase price of an automobile sold to defendant by plaintiff, and the note was secured by a cnai-tel mortgage on said automobile and a team, of mules.
