This proceeding is a petition to enforce an order of the National Labor Relations Board requiring respondent, a partnership engaged in the sheet metal business including roofing, heating and air conditioning at Emporia, Kansas, to bargain with the union 1 and to post appropriate notices. The Board’s conclusion that the respondent violated sections 8(a) (5) and (1) of the National Labor Relations Act, as amended, (29 U.S.C. § 158(a) (5), (1),) was predicated upon the finding that the union represented a majority of respondent’s employees and the refusal to bargain was…
