In Re the Grand Jury Empaneling of the Special Grand Jury
Court of Appeals for the Third Circuit
1Opinion of the Court
OPINION OF THE COURT
SLOVITER, Circuit Judge.
Three witnesses appeal from the final order of the District Court holding them in civil contempt and ordering them confined for refusing to testify before a grand jury investigating their father. The witnesses justify their refusal to testify on religious grounds and contend that the District Court failed to follow the procedures mandated by the Religious Freedom Restoration Act (“RFRA”), 42 U.S.C. §§ 2000bb to 2000bb-4. This appears to be the first Court of Appeals decision to consider the *828application of that Act to a grand jury subpoena.
