The judgment is affirmed. Whether respondent owns without restriction certain shares of stock in a family corporation as a gift inter vivos from his father and mother, or whether he owns a life interest in the income of their equivalent as a legacy under the will of his father, is the foundation of this proceeding. The control of this corporation is perhaps involved also in the result of this action.
