Clark A. Smith, J.:
Henry Knowles died intestate in 1898, and at the time of his death owned several tracts of real estate in Sumner county, and little, if any, personal property. Several of the tracts of real estate, if not all of them, were encumbered by mortgages, and there were some small debts, besides the expenses of administration.
Prior to the death of Knowles the Connecticut Mutual Life Insurance Company had brought suit to foreclose one of these mortgages, and it bought in a certain tract of land at the foreclosure sale at a price which left a…
