OPINION AND ORDER

2Per curiam

The complaint filed by plaintiff Fox in the District of Utah is the latest action to be brought against Texas Gulf Sulphur Company (“TGS”) and its officers arising from the dissemination of news and information with respect to that company’s major mineral discovery in Canada in 1963 and 1964. At present 69 private damage actions against TGS alleging violations of Section 10(b) of the Securities Exchange Act and Rule 10b-5 promulgated thereunder are pending in the Southern District of New York.
