Action in tbe district court for Hennepin county on a fire insurance policy. Tbe cause was tried before Simpson, J., wbo found in favor of plaintiff. From an order granting a motion for a new trial, defendant appealed.

This was an action upon an insurance policy, tried to tbe court without a jury, and upon findings of fact, judgment was ordered in favor of tbe plaintiff for $250 and interest. Tbe owners of tbe property (Hecklin & Stark) were tbe parties insured, but according to tbe terms of tbe policy the amount of loss, if any, was made payable to this plaintiff “as bis interest may appear.” Tbe items of insurance as stated in tbe policy were as follows:(1) “$250.00. On tbe three-story and basement frame, metal roof, flour-mill building, and additions thereto, including engine and boiler building,…
