This is a suit for a declaratory decree in which plaintiff prays for the construction of the provisions of two similar testamentary trusts under each of which he was named as one of the life beneficiaries. The de fendant, Wilbur G. Rowe, was named as trustee. The other defendants are the remaindermen named in the trust. The defendants appeal from a decree construing the trust favorably to the plaintiff.
The trusts were created in the separate wills of Enoch J. Peterson and Nellie R. Peterson, husband and wife. Each of the wills contained the following provision (combined in the excerpt below…
