ORR, J.:

Respondent was granted a decree of divorce on the ground of three years separation. Appellant complains that the trial court abused the discretion vested in it by law, in the following particulars: first, in refusing to set aside appellant’s implied waiver of a jury trial; second, in refusing a continuance in order to permit one of appellant’s counsel to reach Las Vegas, Nevada; and, third, in granting respondent a decree of divorce.
