Error to a judgment of the Circuit Court of Amherst county in an action of trespass on the case. Judgment for. the plaintiff. Defendant assigns error.

This action was brought by John Burford against the Southern Railway Company to recover damages for personal injuries alleged to have been caused by the negligence *158of the defendant company. There was a demurrer to the evidence, which was overruled by the lower court and judgment given in favor of the plaintiff for $1,000, the damages assessed by the jury in the event the court should consider the plaintiff entitled to recover. This judgment is brought under review by the present writ of error.
