Defendant was charged with the offense of perjury 1 in an information containing two counts. Count I charged that he subscribed and swore to the truth of a false affidavit in support of a motion for a new trial in the case of People v. MacCagnan, (No. 160110). In Count II, he was charged with having knowingly given false testimony at the hearing on the motion for a new trial in the MacCagnan ease.
