Plaintiffs bring this action under the Endangered Species Act, 16 U.S.C. § 1531 et seq., and the Administrative Procedures Act, 5 U.S.C. § 701 et seq., challenging the issuance of a permit by the United States Army Corps of Engineers 1 to Del Norte County and the California Department of Fish and Game to breach the sand bar separating Lake Earl and Lake Talawa from the Pacific Ocean.
