NATURE OF CASE

The City of Lincoln (City) appeals the order of the district court for Lancaster County reversing the City’s decision to deny the claim for unpaid wages filed by Marlin E. Rauscher, a retired City police officer. Following an evidentiary hearing, the district court ordered the City to pay Rauscher $2,685.79 in unpaid wages. The district court also ordered the City, in accordance with the Nebraska Wage Payment and Collection Act, Neb. Rev. Stat. § 48-1228 et seq. (Reissue 2004), to pay Rauscher’s attorney fees.
