Action of ejectment in the district court for Morrison county. The case was tried before Searle, J., who found in favor of defendants, whereupon judgment was entered pursuant to the findings. From an order granting a second trial, defendants appealed.

This is an action in ejectment, and is before this court on defendants’ appeal from an order granting a second trial. The order appealed from was based on G. S. 1894, § 5845. The facts are as follows:

*525The action was commenced in 1895 to recover the possession of certain real property located in Morrison county. Both parties by their pleadings claimed title to the property and the right to its possession.
