The motion was made upon the complaint alone, and the notice of motion states the grounds to be (a) defect of parties defendant; and (b) that the first cause of action is to recover damages for wrongful death caused by the alleged negligence of defendant Blau in maintaining an alleged attractive nuisance, and the second cause of action is to recover damages for wrongful .death caused by the alleged malpractice of the defendant Emil as a physician in giving alleged improper and unskillful medical aid and treatment.
