Appeal by the defendants, the Metropolitan Street Railway Company and another, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 10th day of June, 1901, upon the verdict of a jury for $25,000, and also from two orders, each bearing date the 29th day of May, 1901, and entered in said clerk’s office, denying two respective motions for a new trial made upon the minutes.

The plaintiff as administratrix brings this action against both defendants, claiming that they are joint tort feasors in producing *496the death of the plaintiff’s intestate, and are, consequently, liable to respond therefor in damages.
