KaNE, J.:

This was an action • for damages for personal injuries alleged to have been sustained by plaintiff in error, who, for convenience, will hereafter be called the plaintiff, by reason of the negligence of the defendant in error, who for convenience, will hereafter be called the defendant, in leaving unguarded an elevator shaft on the premises occupied by it in Oklahoma City where it conducts a wholesale grocery business. In the court be low a demurrer to th„e evidence of the plaintiff was interposed by the defendant and sustained by the court, and judgment entered for the defendant. To…
