The trustees of the town of Berkeley instituted proceedings under the act of 1889 to open and extend Eighth Street in that town. The lands of plaintiffs were included within the district established by the board, under the act, as among those to be benefited or affected by the opening of the street, and which were to be assessed to pay the damages, costs, and expenses thereof.
