—Appeal by the defendant from a judgment of the County Court, Nassau County (Harrington, J.), rendered October 5, 1992, convicting him of rape in the first degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed.

During the trial, the defendant never claimed that the court’s comments in front of the jury violated his right to present a defense or his due process right to a fair trial, and the defendant never moved for a mistrial on such grounds.
