OPINION

BRYNER, Justice.

I. INTRODUCTION

Ronald Rockstad failed to pay his business's rent on time; his landlord terminated the lease and sued for eviction. Finding that Rocekstad had committed a technical default by failing to pay timely rent but that the default was not material since Rockstad had tendered late payment minutes after the usual deadline, the superior court declined to order eviction, but nonetheless directed Rocekstad to reimburse his landlord's costs of litigation.
