STATEMENT OF THE CASE

lia R. Jesse appeals the trial court’s entry of summary judgment in favor of American Community Mutual Insurance Company (“American Community”). Jesse filed her complaint against American Community, Davenport Insurance Agency, Inc. and Larry D. Smith (“Smith”) seeking damages sustained by her as a result of American Community’s rescission of her health insurance policy. 1 Following a hearing, the trial court concluded that there was no genuine issue of material fact and entered summary judgment in favor of American Community.
