Plaintiff Schlumberger Technologies, Inc. (Schlum-berger), appeals from a summary judgment dismissing its claims under ORS 279.067 against defendant Tri-County Metropolitan Transportation District (Tri-Met). Schlum-berger alleged that Tri-Met improperly awarded a contract for the creation of a fare collection system to intervenor Scheidt & Bachmann, GmbH (S&B). Tri-Met cross-appeals from the trial court’s failure to award it attorney fees under - ORS 279.067(4). We affirm.
