Currently pending before this court is the motion of plaintiff South Seas Catamaran, Inc., to dismiss the counterclaim of defendant PCR Enterprises or to transfer the instant action to a more convenient forum and the appeal from the Order of the United States Magistrate for'the District of New Jersey directing that the deposition of plaintiff’s representative be taken in this District or in nearby Philadelphia, Pennsylvania.
