Presently before the court in this ease are plaintiffs motion for summary judgment on defendant’s counterclaim; defendant’s motion to dismiss plaintiffs RICO claims, set forth in Count Four of plaintiffs Amended Complaint; and two motions, pursuant to General Rule 40D recodified as L. Civ. R. 72.1(c)(1) (eff. Apr. 1, 1997), which seek to appeal certain discovery orders entered by Magistrate Judge Rosen, on December 20, 1996, and January 23, 1997.
