By means of habeas corpus the petitioner seeks to secure her release from custody after having been held by a magistrate in a preliminary examination to answer to a charge of grand theft as provided by section 487 of the Penal Code.
The petitioner, who is the wife of William V. Kellogg, was charged with grand theft accomplished by means of drawing and cashing six checks upon the alleged joint tenancy account of herself and her husband in the Bank of America in Sacramento and by appropriating the money to her own use contrary to her trust.
