Before the court is the motion of defendant, HealthSouth Rehabilitation Center of Memphis, Ltd. (“HealthSouth”), to dismiss the claims of plaintiff Vickie Smith pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure.
