Judgment unanimously modified and, as modified, affirmed in accordance with memorandum, and matter remitted to Genesee County Court, for further proceedings, in accordance with the following memorandum: Defendant pleaded guilty to petit larceny (Penal Law, § 155.25), two counts of obtaining public assistance by means of a false statement (Social Services Law, § 145) and three counts of offering a false instrument for filing in the second degree (Penal Law, § 175.30).
