Plaintiff, Jo Ann Zimmerly Leathers, initially prosecuted an appeal to the Appellate Court of Illinois, First District, from a decree entered by the superior court of Cook County awarding defendant, Jack O. Leathers, a divorce from the plaintiff on his amended counterclaim charging adultery following a jury verdict finding plaintiff guilty of adultery. Upon defendant’s motion this appeal was transferred to- this court for the reason that the terms of the decree affect title to real estate thereby involving a freehold.
